Importance Notice for Caregivers: Payment for Work on Holidays

There were many versions and aversions about the Holiday leave and pay that caregivers in Israel are entitled to get. Most of the employers would let their caregivers take this 9-day leave without pay. Most of the time, caregivers are taking these leaves when they go home to their respective country for a vacation.

 

Some very dependent employers though are paying their caregivers to work on these days and pay them. There were several noticeable differences in terms of the exact amount to pay for the Holiday pay.

 

Just recently, the Commissioner of Foreign Workers Labor Rights in Israel published a notice to the caregiving sector regarding the correct amount to be paid by employers when they ask the caregiver to stay during his/her holiday leave.

 

Below is the official notice from the Commission:

 

“Caregivers, as all other workers, are entitled to 9 holidays per year. For caregivers, the length of the holiday is 25 hours, same as the weekly day off.

Caregivers are entitled to have vacation from work on holidays according to their religion without reduction of their salary. These days off should be coordinated with the employer at the start of employment, and should be noted in the employment contract.

If the caregiver is requested to work on a holiday, he/she must be paid for his/her labor on this day in addition to their monthly wage. The payment should be the same as the payment for working on the weekly rest day. , i.e. the sum, as of today, should be 361.68 NIS.”

 

IMPORTANT NOTE:

 

The Commissioner mentions that if the employer CAN PROVE that the caregiver is the one that REQUESTED to work on the holiday, then the payment for working on the holiday should be only *149.68* NIS (361.68 NIS minus 212 NIS).

Therefore - if working on holidays is requested by the employer, we recommend that you should get in writing the employer's request. Also - never sign any document you don't understand completely.
