Weekend Pay? How Much Should You Get?

Following the minimum wage increase, the payment for working on off days has increaed to a minimum of 380 NIS. The same payment is valid for working on Holidays.

 

It's always been a long debate about how much should the caregiver receive for a Weekend stay with his/her employer. It is also a question of how many hours the caregivers should be allowed for a rest every week. Here's an important note from Kav Laoved that every caregiver, employer and agency should read:

 

Note - According to the National Labor court most updated ruling, in case # 11874-03-16, the minimum salary for work on the weekly day-of must be for all 25 hours, and 340 NIS in total. In this case, an employer who allowed the caregiver only 24 hours rest every week, was ruled to pay for one extra hour of rest she was supposed to receive each week, for her entire working period! If your employer refuses to pay the full amount, please contact your agency, where you can show the Hebrew version below:

בהתאם לפסיקת בית הדין הארצי לעבודה מיום 7.7.16, אורכו של יום המנוחה השבועי לעובדי סיעוד הינו 25 שעות והתשלום עבורו הינו עבור יום עבודה + שעה, במכפלת 150% (לפי שכר המינימום לפחות) = 340 ש"ח.
למען הסר ספק, ניתן לעיין בפסיקתו של בית הדין הארצי לעבודה מיום 29.5.17, עע (ארצי) 11874-03-16‏ מנחם שטינברג נ' יוליאנה טודיקה, בו נקבע כי עובדת לה ניתנה מנוחה שבועית בת 24 שעות בלבד, זכאית לתשלום עבור שעת מנוחה נוספת לה היא זכאית מידי שבוע ולא ניתנה לה, בגובה שכר מינימום שעתי במכפלת 150%, **עבור כל תקופת עבודתה**.
